What is the Ignition Interlock Device?

If you are successfully convicted of a DUI, you will be facing considerable penalties. These will range from monetary fines to sentencing for jail / prison time and could also include the possibility of a driver's license suspension. In some cases you will be facing community service hours and could also face restitution to the victim if you were involved in a DUI accident with injury. These, however, are not the only penalties that can be slapped on the defendant following a conviction.

Recently, courts have been looking more and more favorably on giving what is known as the Ignition Interlock Device (IID). Put into its simplest form, the IID is considered to be a breath test. It, however, is not hand-held device. Rather, it is a machine that is installed into the vehicle of every vehicle that the defendant will driver - this includes vehicles that the machine owns and/or leases, no matter whether they are solely or jointly on the paperwork .

Brief Overview of the IID - How It Will Affect You

The main purpose of the IID is not only to punish, but rather to deter from the possibility of repeat offenders. The machine's purpose is simple. Every time that the subject gets into their vehicle, they will be required to give a breath sample to the machine. If the sample has a blood alcohol concentration (BAC) that is over the machine's threshold - which is typically 0.02% to 0.08% - then the vehicle will start up as it normally would. If, however, the BAC is higher than this threshold, the vehicle will remain dormant and will not start up.

There are also several steps that are put into place to keep from cheating and to allow the machine's purpose to run as it was intended. One of the most notable examples of this is referred to as "rolling tests." These will occur at random intervals while driving and will require the driver to give another sample. If they do not abide by the request or give a sample that has too high of a BAC, an alarm will start to go off and will continue until the vehicle comes to a stop. The incident will then be recorded and will be printed out at a later date for the proper authorities to review.
