On-the-Spot License Suspension

After a DUI charge, the matter is processed through the courts as well as the DMV.  If you are charged with DUI, an order for license suspension is issued at that time.  This is referred to as Administrative Per Se (APS) or on-the-spot license suspension.  The law, however, allows for due process and you have thirty days to protest the matter through the DMV.  A request for a DMV hearing must be made within 10 days of your arrest, otherwise that right is forfeited.
